1. Acceptance of terms

By creating an account or using the AdFuse HQ platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance. Questions: support@adfusehq.com.

2. Description of service

AdFuse HQ provides a platform for creating ad campaign opt-in links, collecting lead data, sending automated emails, and tracking opt-in, click, and conversion events. We reserve the right to modify or discontinue any part of the Service with or without notice.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using AdFuse HQ you represent that you meet these requirements. Businesses may use the Service on behalf of their employees, provided they have authority to bind the organisation to these Terms.

4. Your account

• You are responsible for maintaining the confidentiality of your credentials.
• You must notify us immediately of any unauthorised account access.
• You may not share your account with others or create multiple accounts to circumvent limits.
• We may suspend or terminate accounts that violate these Terms.

5. Acceptable use

You agree not to use the Service to:

• Send spam, unsolicited commercial email, or phishing messages.
• Collect data from individuals without their informed consent.
• Violate any applicable law, including anti-spam laws (CAN-SPAM, CASL, GDPR, etc.).
• Promote illegal products, services, or activities.
• Impersonate any person or organisation.
• Reverse-engineer, decompile, or create derivative works from the Service.
• Interfere with or disrupt the Service or its infrastructure.

We reserve the right to remove content or suspend accounts that violate these rules without prior notice.

6. Lead data and email sending

When you use our opt-in page feature, you are the data controller for the leads collected. You are solely responsible for:

• Obtaining proper consent from leads before collecting their data.
• Complying with all applicable data protection laws (GDPR, CAN-SPAM, etc.).
• The content of emails sent through the Service.
• Honouring unsubscribe requests promptly.

We act as a data processor on your behalf. Our processing of lead data is governed by our Privacy Policy.

7. Intellectual property

AdFuse HQ and its licensors own all rights in the Service, including software, design, trademarks, and documentation. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes. You retain ownership of your campaign content and lead data.

8. Free trial, fees and billing

New accounts receive a 7-day free trial with full access to all features - No credit card charge. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. Accounts that remain unpaid after the trial will be deactivated. Paid plan fees are stated on our pricing page and billed in advance on an annual basis. All fees are non-refundable except as described in our Refund Policy. We may change pricing with 30 days' notice. Failure to pay after the trial may result in service deactivation and data deletion after 30 days.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

10. Limitation of liability

To the maximum extent permitted by law, AdFuse HQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of the Service. Our total liability to you for any claim shall not exceed the greater of (a) the fees you paid us in the 12 months prior to the claim, or (b) USD $100.

11. Indemnification

You agree to indemnify and hold AdFuse HQ harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

You may cancel your account at any time via account settings. We may suspend or terminate your account immediately for violations of these Terms. Upon termination, your right to use the Service ceases. We may delete your data 30 days after termination, except where retention is required by law.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which AdFuse HQ is registered, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of that jurisdiction.
